Legal Studies QCE Units 3 & 4 Practice Question 2 – Rights of states

Q2 Legal Studies Rights of states Unit 4 - Topic 1

Question 2

6 marks

A UN Member State, Lydora, passes a law requiring all foreign social media companies to store Lydoran users’ data on servers located inside Lydora and to remove content that “undermines national unity”. Another UN Member State, Meridia, publicly declares Lydora’s law “illegitimate”, imposes a deadline for Lydora to repeal it, and announces it will conduct “cyber countermeasures” that will disrupt Lydora’s government websites until the law is changed. Meridia also states it is acting “to protect human rights online” and that the UN should not criticise Meridia because each state is “equal and free to choose its own responses”.

Explain, with reference to Articles 2(1), 2(4) and 2(7) of the United Nations Charter, whether Meridia’s response is consistent with the rights of states (sovereignty, equality, political independence and territorial integrity).
