The Direction would set fixed outcomes (e.g. “refuse bail” or “impose a minimum 14 days’ imprisonment”) and would apply even if the judicial officer considers the outcome unjust in the individual case. The Minister states the reform is needed because “unelected judges are undermining Parliament’s tough-on-crime agenda”. Legal groups argue the proposal threatens judicial independence and the separation of powers.

Assume the Bill is otherwise validly introduced into Parliament and is intended to operate in Queensland courts.
